Fire Risk Assessments

The Regulatory Reform (Fire Safety) Order2005 which came into effect in October 2006 requires premises in which persons work or in use by the general public to have a formal fire risk assessment. The order applies to virtually all premises (with the exception of domestic dwellings unless in shared premises) and covers nearly every type of building, structure and open space.

In Scotland this requirement is listed under the Fire (Scotland) Act 2005.

Under the order, anyone who has control of premises or anyone who has a degree of control over certain areas or systems may be deemed a ‘responsible person’ and are responsible for meeting the requirements of the order. If you are the responsible person, you must make sure you carry out a fire-risk assessment although you can pass this task to some other competent person. It is essential that where you decide to nominate this task to a competent person or external agency that you satisfy yourself that they are both suitably qualified and experienced to undertake this on your behalf. The responsibility for the adequacy of the fire risk assessment and adequacy of fire precautions rests with the organisation.
